Sleeper Channel Australia Pty Ltd reserves the right to add, change or delete these Terms and conditions at any given time. Customer should check these Term and Conditions before make any purchase through the sleeper channel Australia website. Please read carefully and understand it well before you make any purchase. Images in the website may not match with the actual goods. Technical specifications or details may vary with the actual goods. The customer acknowledges that data, dimensions, weight, and specifications are in the website only give the approximate and guideline to identify the goods. The customer is responsible to ensure that the goods being ordered are suitable for their intended use. All customers’ use this website are agreed to follow these terms conditions and to be bound by them.
1. Definitions
1a) Customer – Refers to a person or group of people purchase goods through the sleeper channel Australia website.
1b) Goods – Refers to all goods and services provided by Sleeper Channel Australia Pty Ltd.
1c) Deliver Date – Refers the approximate date customer will receive the goods, whether it is a single date or delivery schedule provided or amended by the sleeper channel Australia Pty Ltd.
1d) Price – Refers to the value of the goods which has to pay by the customer to Sleeper channel Australia pty ltd. All the prices specified in sleeper channel Australia website are inclusive of GST (Goods and services Tax). Sleeper channel Australia Pty Ltd will reserve the right to change the price at any given time due to unavoidable circumstances prevailing in the local and foreign steel market. The price of the goods is not included the delivery charges. The customer can pay for the delivery of goods separately depending on the suburbs as specified in the sleeper channel Australia website.
2. Payment Method, Ordering and Delivery of Goods
2a) Customer can pay for the goods by using Visa / Master card only.
2b) Online ordering maybe unavailable due to maintenance and upgrades of the website. Website performance may vary depending on the availability and customers” internet speed. Sleeper Channel Australia Pty Ltd does not guarantee for that.
2c) Goods may be unavailable time to time depending on the stock availability. Sleeper channel Australia Pty Ltd will not be liable for any losses to the customer caused by unavailability of goods, or delaying in supply goods or errors in delivering goods. In the event, where the stock is not available or couldn’t supply the goods at agreed delivery date, Sleeper Channel Australia Pty Ltd will refund the full invoice amount back to the original customer.
2d) Sleeper channel Australia Pty Ltd will need minimum 2-4 business days to deliver the goods once the customer order has been fully paid, cleared, and accepted by both parties (the customer and sleeper channel Australia Pty Ltd). Any changes to the order, shall notify to the Sleeper channel Australia immediately by the customer. The customer is required to ensure delivery site is easily accessible and free from any hazards to receive the delivery. Sleeper Channel Australia Pty Ltd shall not be liable for any loss or damage to the site unless due to the negligence of delivery driver. Sleeper channel Australia Pty Ltd will notify the customer about delivery date via over the phone / text message and do the delivery even if the customer is not present at the site. The customer needs to contact the Sleeper Channel Australia Pty Ltd immediately (within 24 hours) to change the delivery date. In the event, if the second delivery is required at customer’s fault, customer has to pay any extra cost of delivery to Sleeper channel Australia Pty Ltd. Where the goods delivered to unattended site, the customer accepts and acknowledges the risk of damage to the goods or shortages and customer is required to do the immediate inspection and inform any discrepancy to Sleeper Chanel Australia Pty Ltd with in next two business days. Failure to do so, Sleeper Channel Australia Pty Ltd will reserve the right to dismiss any claims made by the customer.
2e) Two days of prior written notice is required to notify the changes of customer details, proposed changes of ownership of the goods. The customer shall be liable for any loss incurred as a result of failure to follow this. The customer is required to contact Sleeper Channel Australia Pty Ltd within Seven days of receipting goods to resolve any disputes of invoices.
2f) Sleeper channel Australia Pty ltd reserve the right to terminate customer order if it found that customer has provided the false or misleading information or violated its terms and condition of trade.
3. Security Policy
3a) Sleeper channel Australia Pty Ltd will take all reasonable steps to ensure that customer personal information is secured. The procedure is in place to protect customers’ privacy when collecting the customers’ information. Sleeper Channel Australia Pty Ltd continually upgrading these systems and reviewing procedures to ensure the highest standards of security measurements are used to protect customers’ personal information. The customer can securely enter the credit card numbers via Sleeper channel Australia website. For all credit card payments, Sleeper Channel Australia will use “Payment gate way” system which is a product of SecurePay - a business of EWAY and is certified to ensure information is encrypted and fully secured. Sensitive credit card payments details are never stored in our website or within our internal database system.
4. Advertising and Marketing Material / Offers
4a) Sleeper Channel Australia Pty Ltd will reserve the right to email product alerts and special offers to the customers when and where necessary. The customer reserve the right to unsubscribe or refuse these special offers, marketing material at the time of placing the order. If the customer, do not wish to receive these special offers and alerts emails, Sleeper Channel Australia Pty Ltd will disable that functionality from the customer’s account. Each and every one of these communications will contain a clear link to unsubscribe and the customer can easily do that.
5 Risk, Limitation, Acceptance
5a) The information about the goods in Sleeper channel Australia website may contain typographical errors or inaccuracies and may not be complete or current. Hence, Sleeper channel Australia Pty Ltd will reserve the right to correct any errors, inaccuracies and to change or update information at any time without prior notice. These errors and inaccuracies or omissions may relate to goods, pricing and availability. And also, Sleeper Channel Australia Pty Ltd will reserve the right to limit quantities at any given time even after receiving the customer order. This will be directly communicate to the customer and will refund the amount for the variation immediately.
6 Refunds, Returns and Warranties
6a) The customer can returns the goods for a refund due to the defects of goods or change of circumstances within Seven business days of receipting goods. The customer must inspect the goods immediately on or after the delivery. Any evident of defects / damage, shortage of quantities supplied, must notify the Sleeper Channel Australia pty ltd within seven business days of receipt of goods to get the refund or replace the defective goods. In the event where refund / replacement occur at Sleeper Channel Australia’s fault (defective goods / short supply of goods / error in supplying goods), will proceed with the refund / replacement of good at zero fees to the customer. And also, when the customer needs the refund, or change of sizes / profile within seven days of receipt of goods due to change of circumstances, at the discretion of Sleeper Channel Australia Pty Ltd will work with the customer to collect the goods providing they are in original and resalable condition from the site where the goods were being delivered originally with a freight collection fee as well as a re-stocking fee. The customer needs to ensure that the goods can be easily and safely collected from the original delivery location.
6b) The freight collection fee is $150 inc GST. This covers the cost of collection, handling and re-stocking at warehouse. This fee is payable by Credit Card at the point of booking a collection. Restocking fee for return goods without collection by Sleeper Channel Australia pty ltd is $50 inc.GST.
6c) All goods supplied by Sleeper Channel Australia Pty Ltd, comes with guarantees that cover under the Australian Consumer Law 2010. Sleeper Channel Australia Pty Ltd liability is limited for all other losses, damage or injury arising from the use of its goods to the extent permitted by law. The warranty does not extend to any form of damage, or loss which caused by accident, misuse or negligence.
